How to Choose a Software Agency Without Getting Burned

Agencies · 9 min read · Updated 2026-04-10

Most software agency relationships fail in the first 60 days — not because the code is bad, but because the contract, scope, and communication were wrong from day one. Here is how to choose one that actually ships.

Look at shipped work, not slides

Anyone can make a pretty pitch deck. Ask for live URLs of products in production, with real users. If they cannot show you 3 things shipped in the last 12 months, they are either too new or too slow.

Fixed price vs time and materials

Fixed price works when the scope is well-defined: a marketing site, a specific AI agent, a clear MVP. Time and materials works when you are exploring. Beware of any agency that insists on time and materials for a project you have already fully specified — it usually means they cannot estimate.

Who owns the code, the data, and the accounts?

Get this in writing before signing. You should own the code, the GitHub repository, the cloud accounts, and the domain. If the agency holds any of these hostage, you do not have a software project — you have a leash.

Red flags

Walk away if you see any of these:

  • They cannot explain their stack choices in plain language.
  • They promise a fixed price without asking detailed questions.
  • Communication is slow during the sales process. It only gets worse after you sign.
  • They sub-contract everything offshore but charge full Western rates.
  • They have no opinion on what you should build — good agencies push back.

Questions to ask before you sign

Use this short list in your first call:

  • Who specifically will write my code? Can I meet them?
  • What is your typical post-launch support model?
  • How do you handle scope changes mid-project?
  • What happens to the code if I cancel halfway?
  • Can you share a recent post-mortem on a project that went wrong?

Frequently asked questions

What is the average cost of hiring a software agency?

Pricing depends entirely on scope. A quality boutique agency in Europe will scope your project and quote per project — never trust a number quoted before the discovery call.

How long should a software project take?

A marketing site: 2 to 4 weeks. An MVP SaaS: 6 to 12 weeks. A production AI agent: 3 to 6 weeks. Anything longer usually means the scope was not nailed down.

Should I hire freelancers or an agency?

Freelancers are cheaper but you carry the project management, QA, and integration risk. An agency costs more but the result lands as one shipped system.
